It would also require quite a different gameplay set-up to adjust to the different battle style to regular Total War games.
It's a possibility one day though.
Honestly i am not sure i'd like CA to try their hand at it, i cannot imagine the ranged combat working very well as a Creative assembly game, the battlefields would need to be considerably increased in size as-well to accommodate for the range of the weapons
Wrong. SEGA does have 40k license. So CA actually can make a 40k game.

Would Sega need to negotiate for a new project with GW, sure. Does not negate anything i have said though. Sega is probably in the best position in the market to start a 40k project with CA.

The closest you're going to get to TW:40k is Dawn of War: Soulstorm. Yes I know it's about 15 years old at this point. It's got a turn based campaign map with various factions, a tiny amount of province development, and RTS battles.
while original board game of warhammer 40k totaly destroyed the concept of bigarmies, it was rather like skirmish size battlewith heroes/single unit, few monsters/vehicule and small squad. the idea was to simplify access to people.
