What do you mean tried? Starcraft is warhammer 40K.
But they've also been ripped off all the same. Warcraft was a Warhammer game originally till they decided they'd rather have their own license. Even today a good portion of their new lore has roots in Warhammer, just dressed up and mixed around a bit to be "legally distinct".
Starcraft did the same to 40K. Zerg are basically Tyranid. Protoss are an unholy combination of Tau and Eldar. Space Marines be Space Marines.
It's an odd situation honestly. Copyright and Patents are important because that's what encourages people to create greater works and advance technology. But then you can see how some works have strongly benefited off of borrowing ideas just to turn around and try to keep them for themselves.
In theory, the hope would be that people just develop new ideas entirely, but people have a lot of attachment to existing ideas because they're already appealing.
Not just Starcraft.
Warcraft was originally a Warhammer Fantasy game that they tried to slip out, GW got wind and said 'Um...we never signed off on this.' Blizzard went 'Better to ask forgiveness than permission?' And GW's response was 'Nope. And now you get neither. Ever.'
Then they tried AGAIN with Starcraft. Both times they had to do revamps before release because GW caught them and said 'And...HELL NO.' Thus we have Blizzard's big two IPs birth.
I reccomend Warhammer to everyone, specially the religious.
Just remember taht Warcraft 3 Frozen Throne changed the name of the Night Elf Ballista to Glaive Thrower, the Wyvern Rider to Windrider and the Steamtank to Siege Engine, because they got hit with a lawsuit from GW.
Blizz used to be known for very polished gameplay, not originality in any way.
All their famous IPs are copy-pasted from something else.
When GW rips off on something, no one says anything. When someone else rips off on GW, everyone loses their minds.

Skrew Blizzard, they should have not ruined Warcraft and Starcraft, by making them Kiddy Grade.
Long live GW, who does not shy away from actual dark and heroic themes.
Hope you are ready for the kowtowing to SJWs because its already begun if some of the more recent BL books are to be believed
Except that GW has already sent a second leyyer saying Warhammer is for everyone, including the people the SJWs do not like.
Patreon also recently lost a case that will kill deplatforming in the future.
Then there is the disaster of Disney Star Wars and Marvel, which is proving to companies that SJWs do not even buy the products they demand the change to.
BLM riots arew also backfiring massively, and made people less sympathetic to their cause.
SJWs, like hippies, will soon be a ghost of the past.
I was talking about a different book but yeesh if the they actually tried to sue whoever owned the IP for Starship Troopers.

When it comes to CA (The developers of this game) they are good in my book, but arguments can be made that their DLC policy is greedy (Personally i just like additional content being added continuously keeping the game fresh, but if you have a limited budget or don't want to spend to much on the same game then the amount of DLC (not to mention the game 1 + 2 content including all games 1 DLC) may be a issue for you).
When it comes to Games Workshop they are... well... douchy at times (In my humble opinion). They have always struck me as a company that does not really know what its doing half of the time and that doesn't connect properly with their consumers (again my humble opinion and without and proper data to back it up, just assumptions based on casual observance).
