How do I get it without killing him also where can I find him when he leaves town can’t steal because of his guards

I'm pretty sure this is one of those "if you want the key... you have to kill him when given the choice". And that you cannot find the banished NPC walking around.

Some people early on once claimed you could pickpocket it but I don't know if that's confirmed at all.

You can pickpocket it but the guards attack if you do and I don’t know if you can surrender
