If a customer did what Kern did to your employee, and you sided with Kern instead of the victim of harassment, then you're not as good at this business thing as you imagine yourself to be. You would, by all standards of business, be viewed as the "bad employee" in this circumstance as you'd have opened yourself up to numerous avenues for a wrongful dismissal lawsuit.

If I was the dev and everything went down identically, I would have fired Bask on the spot. I would also do an internal review of all the employees that handle community relations, mods and other community managers, to make sure that Bask didn't sour the milk. As in, if other mods and/or CMs are trashing customers because Bask acted like it was okay. Then those employees would be fired as well. It is unacceptable.
Any law suits in court wouldn't hold up as I would have receipts of said actions.
