cant figure it out

specs rtx 4090 i9 13900k 64 gig ddr5 installed on a nvme ssd

when the game is on the ship maxed out at 3440 1440p my frames are at 40 but when i switch to low settings my frames are still 40fps

I run the game at 1440p with mostly high graphics other than cpu intensive settings like shadows. Runs at 90 fps but I can pretty reasonably reach 120 with reflections turned down. Sorry you're having issues, that's really strange

I have the same cpu, but I barely have more than 30 fps, there are moments where it reaches almost 60, but then it comes back and drops to 30 and the cpu is used at 100%

If my i7 8th Gen + GTX 1060 (6GB) with combination of Low/Medium settings can run this game at 1080p 50-60 fps, Your i9 and RTX 4090 should not be running this game at 40 fps. You probably need to check something in your settings or it could be an app running in the background that's messing with your game.

I laugh whenever i see 4xxx series users always have FPS issue on any game forums I visit when the 2xxx let alone 1xxx or 3xxx have no issues.
