Just for future reference with any game, you can open the Nvidia Control Panel, go to "Manage 3D Settings" click the "Program Settings" tab, and select the game from the drop down menu, or press "Add" to find the games executable and add. From there, scroll down to vertical sync, change it to "On", press apply, and you're good. Nvidia will then overwrite any game settings to ensure Vsync locks you at 60.

I can still see it happening in Episode 2. It doesn't seem to go away. It seems to have nothing to do with graphics or even playing the game since I see it happening on a set interval in the menu. This has got to be a DRM check.
