In the rescource recovery tower 9S finds a document about the nature of "black boxes"
It is explicitly stated that YoRha androids are made with an alternated machine core instead of proper Android A.I because that would be "cruel". This means the humans made androids did not believe machines to be capable of grasping emotions, which is usefull for androids designed to be killed off repeatedly and eventually disposed of.
And yet, A2 has a memory/personality profile built on human leftovers.
1- No, they got their AI from other androids.
2- Pretty much believe it´s not allowed as a custom, not a law. Just as in the military.
3- In those 6000 years the machines had all the opportunity to destroy the server. It´s clear they have the advantage in quality AND numbers and were holding back the whole time. FFS, with one attack they wiped YoRHa.
The bigger question is if Adam was created on purpose or was another accident like Pascal, but that went waaaaaaay beyond the network´s imagination.

- YoRha androids are created by other androids. They have emotions built in to them by progamming the memory of a past human into an android. The point of this is for self evolution and growth for the sake of combat effectiveness. However, for the same reason they, they understand fear, regret, grief, etc. (this is based on the play. A2 has hugely developed emotions. She resembled little girl at first to the now cold and distant android after losing her team. Whether models built after A2's generation kept implanting memories I don't remember).
- The Red Girls did NOT know about the lack of existence of humans. Due to 2B's types' secret mission of killing off intel collecting androids, even the higher ups of YoRha were unaware of humanity's extinction. However, the Red Girls found out the truth after hacking into the moon base towards the end of the game. They later changed their goal of shooting a cannon at the base to propelling present information into space to preserve in attempt to fight the inevitable damnation of androids (I'm a little bit iffy on this last bit, it's been like a year since I played the game).
Commander knew about humanity being extinct, and so knew YoRHa creators, so I don't know what do you mean by "higher-ups" :P I'm pretty sure N2 (aka. Red Girls) knew too - they had access to Bunker files for a long time.
N2 actually changes the cannon into an Ark, and flies away with the whole machine network to search for a new homeworld and to give androids a chance :P
Again, the only real question is why Adam was created by accident or on purpose.
My guess, from having played Drakengard, is that the machines lifeform got somehow "infected" by god's will (or the gods plural, in the outersea version) which would explain why soon after the WCS disease disapear, something new came in the sole purpose of "destroying humanity".
If you remember, each machine lifeform have its eyes glowing red, like the Red Eye leading the Legion in the events of NieR, or like Manah and the empire soldiers in Drakengard (as they are controlled by the watchers, a creation of god).
Also, machines lifeform have this unbendable will to "KILL HUMANS". Even when they don't want to.
Plus, once the Red Girls learned that human are all extinct, they suddenly give up to destroy the androids. (And they look alot like Manah too).
Why would the machines differentiate full-sentient Androids and their creator the humans?
My guess is it's the god will to erradicate humanity, in drakengard god used the watchers to control the empire in order to defeat the seals to bring the seeds of destruction (aka the watchers baby salt statues coming from the sky)
Then the watchers used the WCS to create the legion and slowly kill all humans.
Then the watchers used the Aliens and their machines lifeforms to destroy all humanity...
The more important points toward this theory is the fact that machines only target humans creatures, the red eyes, and the Red Girls closely ressembling the Red Leader in Drakengard (Manah).
