So yeah, it is buggy.
One consideration I would make is that Funcom devs should have revised the idea of having a "humongous" AB for everything, and a convoluted state machine before introducing yet another state of control given that the original system in which those fatalities were introduced already did not worked correctly as intended.
Funny thing is, it was working perfect earlier, it just went bad after one of the hotfixes.
It's showing info about "not finding emote in data table"...
There are lists of reports of it in the Funcom Forums.

they probably do what they do best, ducktape patch it and call it fixed. untill they do a major update again and ripoff that ducktape.
To date, I do still experience the bug. It happens on (humanoid, obviously) enemies inside certain dungeons, and noticed first while doing the Jhebal Sag one. The Wine Cellar is affected too.
Every time it happens, I have to make myself admin, enter creative mode and press the space bar twice to enter in flying mode. This makes the enemy to fall dead and I can then quit the creative mode and resume my playing.
After the Age Of Heroes update, this is still a bug... Wow... Having bought this game really feels like being victim of a scam for such an unacceptable quality at coding and de-bugging.
