The existence of RED and BLU alone could be a violation of the Geneva convention under the premise of them being unlawful combatants, but it’s worth noting that the Geneva convention only governs armed conflicts between sovereign nations.
RED and BLU can be just as good as actual nations.
That aside, do you actually think flamethrowers are okay in videogames?

And since Team Fortrss players are mostly children, and flamethrower's damage is practically non-existent, it can invoke them to think it is the same in real life.

if you want to stretch the definition of sovereign nation then I guess both halves of 2fort can be their own nationalities, although there’s still the issue of these two nations never having signed the Geneva convention and conducting what is essentially an illegal (and lawless) private war between each other. Their existence as PMC’s alone make them unlawful combatants who are not protected by the conventions. Them existing inside of a signee’s borders doesn’t really mean anything, they’re not a national military nor are they affiliated with the US government in any capacity.

You can just say your game takes place in XXXX date if they banned the thing in YYYY to bypass.
