STEAM WORKS
considering that it's only been 4 months, Valve has yet to make such a change. doesn't mean they won't. in fact, they probably dropped support because they plan to make such a change and don't want to waste time with an OS nobody uses.
Since I still want sound however I will be using the 32bit executable (tf.exe rather than the 64 bit tf_win64.exe) with '-steam' parameter until hopefully Valve hotfixes whatever is relating to the audio stack that crashes on Win7/8.1.
Honestly makes sense it was related to audio.
add a non steam game
navigate to tf.exe (32 bit version of tf)
add it and then in properties type "-steam"
THIS WORKS
added -steam to the name of tf.exe and launched got into a local bot match, POSSIBLY RELATED but i have -dxlevel 95 on too in launch options of steam.
still good to know what was causing the crashes
