You don't know the definition of passive effect, in the context of tf2.
Passive effect: Weapon does not need to be drawn to utilise, eg DDS, Vow, drain on the blut, bonus health from the backup
Active effect: Weapon needs to be drawn to utilise, eg Winger, Amputator, Powerjack
Passive effects are nearly always seen as upsides (or downsides) due to always being present whereas active effects are much more situational.
Hence:
The Amputator's upside is just insignificant. It has healing rampup and it's an active effect.
