Crits are balanced by pitiful max capacity of 3 and massive damage falloff.
Crits are lost on death or if obtained when already dead.

I take it you were dominated by some bloke who wielded this weapon, so now you want it nerfed?
The clip penalty is much less impactful on engineer than most shotgun classes because engineer plays a more passive and defensive playstyle. He doesn't need that kind of firepower, and his sentry does most of the work anyways.
Meanwhile you get crits just for getting assists from your sentry, which is just about one of the easiest things to do in TF2. Your aimbot 144 DPS gun with massive range and no damage fall off will have no trouble at all farming assists from even good players.
This weapon would be balanced if it gave minicrits, but enabling a passive class like engineer who has an aimbot bodyguard behind him to have the ability to deal up to 180 dmg at range is ridiculous.
And plus it's really easy to kill an Engineer who is just charging at you with crits. Because they get tunnel vision super easily.
