I spoke to Daius and he told me to go away, quest said to check out his actions, I missed the window and went straight around to the back, now he is too far away and the gates are locked and I cant get near to spy on him. How do I get the gate open does this mean I have to restart the game from the begininig

Leave and load the game again, likely you will get again the prompt to spy him. This usually works if you find a minor bug, I had a NPC inside a building, reloaded and everything was fine.

Hello !
It's normal, the gate won't open at this moment of the game. You have to activate vampire vision
to activate eavesdrop zone and spy on him behind the gate.
