(Well technically they do, since the top tier penthouse can't build on top of its balcony.)
Okay I booted it up to take a look, and I was wrong in my first post. They are called one bedroom apartments wtih a balcony, and you can move in either 1 BR Apartment (right patio) or (left patio) as well as Luxury 1 BR Balcony Apartments (L and R). No idea how I unlocked them, but they are most of my living spaces in the game I booted up.
I suspect you need an interior decorator for the option to unlock. sorry I can't be more specific.
I booted up a new game and I have the option to build them right off the hop. Maybe you are talking about the pent houses? Regardless the game will tell you what you are lacking if you can't build it at this time, be it prestige or a media campaign or whatever.
For unlocking: READ the mouse scroll-over tool-tip bubbles for "requirements" to see what you must have to unlock whatever; such as parking space or HVAC (a.k.a. Air Conditioning - minimum is THE level -1 PUMP).
Medium and Large Rooftop Penthouses are the ones with a patio option. You have to build them on the top floor of your building, but you can place multiple on one floor, and place flooring over them after placing them (although the PATIO part of LARGE penthouses is two floors tall, so they will cut off your building somewhat.
