Well that's pretty frustrating and not at all explained...thanks...given the "rooftop" supposed nature of the structure, having a pile of them makes no sense...there's probably a fair bit of heavy editing in the names of things and their descriptions that could benefit your game.
Might also be a good idea to not give the player contracts they don't have the requisite DLC to complete, as it can be gamebreaking.
Also, the contracts can be done without the DLCs, even on narrow buildings.
The penthouse need to be on the top floor when it's build, but not after. Once you have build it, you can keep building over it. You just need to leave an extra space over the balcony.
(But if your tenent leave, you will not be able to rebuild it.)
