There is no drawback (other than not being able to replace losses), but it is somewhat an exploit.

I see. I went into a capping frenzy, wasn't realized i have exeeded my limits :D

Really ? The game should not have allowed to add a ship beyond you command limit.

Besides capping i was liberating prisoners, maybe that caused it?

That is more likely.

Any chance of being able to mass scuttle? I did the sidequest for someone and every now and then they dump some useless mk1 gunships on me as a "reward" and it fills up my fleet cap if I don't micromanage it.

There are very simple ways to exploit the cap limit. For example, sometimes once you've completed a faction side mission you will sometimes get ships (of the chassis type said faction uses). You can continuously get these after you reached your fleet cap, although after the cap is breached you only get ships below a cruiser with this method.

Buying ships from civilian missions and freeing prisoner will swell your command capacity... hell I had twice the amount of capital ships of my limit doing this. 19 capships/out of a limit of 9. And 100+ fleet command points out of a cap of 65.

Downside is you get mostly destroyers and smaller ships that way. With a handful of cruisers and the odd battleship and the very rare dreadnought this way.
