it's a brand new computer with windows 10, purchased 1 week ago, the latest directX driver is 12. I assume that Garry's mod still runs on 9, is there a patch somewhere?

DirectX will fallback to older versions if required. GMod / Source in general was never compiled for DirectX 12, so it will fallback to DirectX 9 instead.

tl;dr Any install of DirectX supports all DirectX versions, including 6,7,8,9,10,11, and 12.
