Undertale

Will I get a copyright strike on YouTube for the music?
I absolutely love Undertale, and one of my favorite parts about it is the amazing soundtrack. So I was wondering, if I use it as background music in some of my videos (Vlogs/Commentaries) will it get taken down? Even if I give credit to Toby Fox and provide a link to his official Bandcamp?

Nope, seen many vids who use it as background music. Like unrelated vlogs, tf2 discussion vids, intermissions on twitch

As long as you don't get money out of it, I think you're fine.

OMG! ARE YOU STUPID? THATS FOR THE UNDERTALE WIKIA! NOT FOR THE REAL GAME! READ BEFORE YOU POST! PS: Only if you Say that the Music isn't yours, and you give credit for the music to Toby Fox, then Yes, You Can use the Music in your videos, =) (that is, how i think at least) PS Again: Crafted, Dude, Those Rules are for the Undertale Wikia Only, not for the actual game you idiot

I'm pretty sure Toby is really good about preventing people from striking his stuff in his name. He knows how fans are, and more importantly he knows about exposure, and before this game he really wasn't well known.

From what I have heard, he goes out of his way to prevent Youtube from striking his content on other people's vids.

If you're really afraid, the ten bucks for the soundtrack would do him a lot more good than the YT revenue-pittance. I say don't worry about it. Konami he ain't.

The question whether stuff gets tagged by content id or even receives a copyright strike is a different one from whether something violates copyright.

It seems Toby Fox is pretty lenient in that regard. In fact most creators don't target obvious fan content even if it does violate their copyrights. But it may depend on your content.
For instance putting copyrighted music in the background of a highly offensive video whilest trying to make money off it may provoke a reaction from even the nicest copyright holder.

The only way to be 100% save (from a legal point of view) is either getting written permission from the copyright holder or having a solid fair use case.

Materia Music Publishing is Toby's music publisher for the Undertale soundtrack.

We did not register it with YouTube's Content ID, so you are welcome to use it without getting a strike or claim. If you do, it's someone else - if that happens, email us: info@materiamusicpub.com

Given the complexity of music rights, some international organizations may still identify UNDERTALE music, and you may get a claim (but not a strike.)

If for some reason you need a license for YouTube, or legally selling a cover, you can also email us.

As always, please be respectful and give a good impression if using copyrighted Undertale content. Cheers.
