Ahhh! Spoilers! :P
German translation refers to "the orphan" as she, but that's probably since that language has genders on every noun.
Dev team officially said it's up to interpretation. Some devs publicly say he, some dev's publicly say she. Microsoft's descriptions used he early on.
and also that thing with one life mode wasnt that of a big spoiler becouse you can die already in the beginning by running to the right :3
MS gave some advice during the development. But it was always just advice, not orders. Some of it was subtly great, such as right to left instead of left to right for intro (as evidenced by the TGS trailer, left to right was the original build).
But Moon was never obligated to actually follow up on the advice. Sometimes they chose to keep their original design and not follow the advice as the case was with the ending which MS suggested would make Kuro feel like the hero instead of the player feel like the hero..
