In anycase, the clowns in charge of interplay at the time obviously decided to package Herve Caen into the icons of both games before they officially handed them off to Bethesda, likely to never be touched in any official capacity ever again, although I hope i'm wrong.

All sorts of crazy legal language goes into deals, sales and various other contracts, you've seen what EULAs look like "You've no rights, if you got a problem, get ♥♥♥♥♥♥ because we can pay for lawyers and you can't". I can only imagine the crazy language that goes into deals between big brand companies(yes interplay used to be quite an excellent brand).

Both Bethesda and Interplay blew through a couple million each fighting over "Fallout Online" and its still not clear whether or not Bethesda owns the rights to that now, or if Interplay still gets a chance at it.

Anyway, no discredit to Timeslip and the many contributors to keeping Fallout 1 and 2 alive, but the fact that Fallout 1 and 2 are basically just using a third party software bundle so that it remains playable in 2025 shows what little respect Interplay had for the franchise when they let it go.

And that is why the icons show up as they do on the desktop. No respect.
