Funny story, I was attending the execution at Gallows Hill and there's a bunch of guards there too. Immediately after the cut scene ended they we're like "Oi, empty your pockets!"...I was like, 'dude wth'...

this "Search Henry" mechanic only exists in Rattay
the mechanic works by increasing the guards overall "Desire to Search Henry" each time Henry commits a crime in Rattay
( and "no", Henry does not need to be "seen" committing the crime in Rattay for it to count - the effect is applied as guard omniscience (awareness?) - the best RP explanation i've heard is that the guards are fully aware Henry has been sneaking about )
but the Guard's "Desire to Search Henry" is countered by Henry's Charisma (clothing and cleanliness) and his Speech skill
this means that as Henry develops his skills, it's less likely he'll be Searched
p.s.
i'm pretty sure there is a "Search Henry" cooldown - so the best time to go 'a robbin' might be right after being searched (during the mechanic cooldown)
I try to play my first run without intentional crimes, but sometimes some meat is marked as stolen because I hunted too close to Rattay or maybe some book I saw was too good not to be taken :D I usually put these things into my horse inventory asap, but never found out if that is searched as well.
That means that unless you're brain-dead you probably won't get caught with contraband.
So unless you're dumb and greedy, the key issue (in town) for poaching is how much can your horse carry.
And if any of your weapons and armor are hot, keep them in your saddlebags and never carry them on your person.
i've heard both answers
the most popular answer is that the "(horse inventory is not included in a guard's search)"
(some of the earlier reports said it may be related to distance from horse)
i've never tested it - since i'm mostly done stealing (in Rattay) by the time i have a horse
it is certainly true that guards will never search you if you are mounted on a horse
Crime is up. They suspect everyone, including you. Keep your stolen crap in your saddlebags.
I remember doing that as a newb and buying a horse before I knew the main quest has one for free
