Rattay guards telling me to surrender and that I've committed a crime… no idea why
This happens when fast-travelling from the Mill to Bernand's location. Can it be because I'm wearing Talmberg gear, which is technically stolen? Or is because it's night time?

Traveling (even fast travel) at night without a torch is a violation. If you're on foot or slowly riding a horse, the guards will warn you at least once to get a torch, If you're fast traveling they can't do that.

I find the reaction of the guards very unpredictable. Someone yells 'Thief! Somebody stop him!' and chases that NPC. I went after them, caught the thief, knocked him unconscious and brought him back to face justice... only to have the guards all over me for assaulting a poor, innocent citizen.

My reputation with the guards dropped a couple of times without me realizing why. Only today, I learned that if you fistfight with Milan, Ringlet or Steven and you don't crouch when you're looting them, they'll report you as a thief. Night time, and if you're moving through Rattay, even on Fast Travel, the guards will try and stop you. Of course, you're on fast travel, so you can't stop, but the guards don't take into account that you're unable to stop because of fast travel, so you're running from the law in the AI's logic.

Wearing or carrying stolen gear does not immediately trigger a guard to stop you, either, that's a random chance based on your reputation and charisma. Lowly peasant Henry will get stopped often, while high-falootin' noble's son Henry will almost never get stopped unless your reputation is in the tank.

Even if you're stopped wearing stolen gear, it's possible to get out of a search with a successful speech check or sufficient bribe.

I suppose unpredictability is part of life, though in games I tend to prefer things to be predictable. Sigh. I guess one can't have it both ways — either it's full-on game theory and number crunching like it's poker, or you have a less science, more art sort of gameplay in which things happen in ways and for reasons you can't fully comprehend, predict or control.
