One exception: The fighting on the north-south road from the Monastery to Samopesh can sometimes draw REAL guards from the Monastery (because of arrow fire) towards the area, so be careful about that.
I just kill them all.

The guards are responsible for maintaining law and order so your interference is seen as just that: interference. They then act accordingly.
It's best to try to avoid such skirmishes if possible and maybe watch from a distance. If the bandits are victorious and kill the guards, then feel free to charge in and finish off the brigands.
