Provide him the potion and i think he will be able to stand up and not sleep to much. He is in pain right now and have to sleep. Joint pain so i guess he has arthritis or something.

No need. Just pick the option to ask about Elishka's family instead of "the Bailiff sent me".
It doesn't matter what or if you talk with the Baillif.
You'll get the quest to get him some Embroication potion. Either have one ready in your inventory or go buy one from the apothecary. After you deliver it, he'll act normally from then on.
I never got this option on my first playthrough a few years ago, and I didn't get it this time around either. I really wish this game had received a little more love :/ Hopefully KC:D 2 will be smoother sailing than 1, with Warhorse's now much larger dev team.
