Report a translation problem
I do know NPC's often run after they yield and don't get spoken to. Maybe that's what happened?
Go back to an earlier save?
Indeed, meanwhile, I went back to an earlier save (in face I made one very nearby) and this time took another approach: try to persuade instead of fight him (even though my strength options were indicated as being better in this matter) and that made it happen correctly.
Still, this is a bit sloppy of the game creators. If Henry would indeed be locked in that part of the mine, I'd have preferred a "Game Over". Now it seemed like I needed to find a secret hiding or so.
