If you want to do what is asked I don't have to be very persuasive. If you strongly oppose my suggested course of action or stated opinion you might refuse outright and report any (by your opinion) inappropriate action to Steam moderation, or your (or my) local law enforcement.
Henry faces similar problems with persuasion when his plan clashes with other people's. How much the other person cares about the topic matters more than skill level. Choose the option which matches the other person's likely desire line, rather than the one which will cause offence. When you put someone's back up, then you are far more likely to be refused.

Now you also have to choose the *way* you will persuade. Trying to intimidate someone who only wants an easy life and to wake up tomorrow is easier than intimidating someone who's reputation depends on their integrity or nobility, even if they are less 'mighty'.
Telling a 'noble' what he must do... possibly going to go down less well than asking for his help.
Telling someone a lie, when they know the truth.. going to fail. Telling someone the truth when they suspect something else instead... might be more flexible... as would telling someone a lie when they have no idea.
I suspect so but others can confirm. It could also be that it's possible in every situation to get through a speech check technically, but that you are almost certainly not going to have those stats at that part of the game. I'm unsure if every single interaction has the possibility of a successful peaceful outcome if you pick the right option, but again especially early in the game you might just not have the stats.

Was 5 points higher then the guard and he just calls me a filthy liar :(
I use the herb perk so even with dirty armour and such its around 14-15 charisma ^^
Later on in another playthrough I passed one to get away with 4 murders in the street when my speech was only 1 level higher.
The speech check system is broken tbh
If it told you what the mitigating and aggrivating factors are I wouldnt care so much, but trial and erroring your way through the speech system is just dumb.
Like the last guard still wanting to have a go and not being frightened of you after putting 7 of his mates to the sword in front of him it's ridiculous.
Well, you're right that the system doesn't make total sense. In Skyrim, if you commit a crime or attack guards you are persona non grata (subject to arrest or death) in the entire province. In this game, I killed a civilian because I accidentally shot him with an arrow and I wanted to make sure it wouldn't come down on me--- and what happened? In the next town I rode through I was attacked by the guards and asked to pay a fine of 80 gold. I'm almost positive that nobody else witnessed the crime. I paid because I had 50K gold.
But your query of the the last guard of 7 standing his post and going down fighting? That's honor and duty. If I'm faced with that I would hope to do the same--- probably wouldn't.
