Can you get unbanned after penalized?
So I was enjoying some good dark souls 3 while waiting for my friends when suddenly i got invaded by a guy who gave me souls while hitting me, i didnt really pay any attention to it but after a day or two i got a message that i was penalized. My question is: is it possible to get unbanned after penalized? i just want to play with my friends again and i dont have money for another copy of the game

A) You don't need to get another copy of the game, you can just make another Steam Account and enable Family Share. That way you can play the game on your new Account. You'll have to make a new save file but at least you can play online normally that way.
B) There's no way to get unbanned.
C) Make a backup of your save file frequently.

D) delete your save on the main account (the actual file), create a new character and reach the high wall playing online. There's a rumor that if you still have invalid data in your main account, your alt accounts will get banned too. Cleaning your data prevents that (other than opening to you the possibility of being unbanned, in case bans just last many months instead of being permanent.

If you have a backup, you can restore that, instead.

He was being given souls on hit, he didn't pick them up. He also didn't know it was a risk to keep them (I guess) and didn't get rid of them.

To answer your question, no. You will virtually never get unbanned.

So I contacted bandai and apparently my ban isn't permanent so yes I can get unbanned if I just continue playing clean

How do you get in contact with Bandai?
It happened to me something similar to you. I got invaded by a dude near the Pontiff Suhlyvan, that hacker attacked and killed my character and I decided to erase that save and install a back up. And now I have a message of "you have been penalized..."
Is there a way to submit a ticket?
1) Don't waste your time emailing Bandai Namco

2) No, replacing your save file will not do anything. Nor is it reversible via any other means

3) No, you can no longer get unbanned after penalization

Anything said to the contrary is misinformation being spread by nublords. Family share is your singular option. Combine that with a prog called DS3 Manager and you can transfer your old save over to the new account. If this bans you the following Wednesday (bans go out at this time, weekly, and at no other; also, it might not happen at all) you can repeat 4 more times, extending your play total to 4 weeks before a re-buy would be needed.

How frequent is this problem? I was never really interested in pvp, and after learning this I'm even less interested. I've been playing online, because I enjoy the message/blood mechanics, but I'm very tempted to just turn it off now.

But they answered me and helped me out to check if the ban is permanent or not

The sad thing is, they actually don't know anything. They tell you that they are temporary because they have been temporary before, but nobody has been unbanned since the start of 2018, it seems.

I have been banned since February 23rd, 2018. If I remove the game from my library and then purchase it again, will I still be banned?

This is a genuine question because I really would love to play this game again. I don't care if I have to spend the money to play it online once more.

B) is false. To get unbanned, you need to delete all characters. Then make a new character, take him to High Wall bonfire. Quit, and wait a few weeks. You'll be unbanned.
While you're waiting to get unbanned, do A)

Ran into couple of cheaters in 300 hour of playing DS3. However my friend ran into few more cheaters. Neither him or me got any penalites thankfully.

To be honest while PvP can be fun it's just not worth it. I was thinking the other day maybe I should install the game again and have some PvP fun but then I remembered that you can just run into 1 cheater and that will be the end of your account.

I'm happy that there are extreme actions taken against cheating, that's a really good thing but how these devs handle them is just abit too much. It's like russian way of saving hostages, gas the entire building so the bad guys die even at the expense of some civilian casulties.
