You might have more luck grabbing him as he turns the corner to move around

My frustration with this as a sorceror (I probably should have casted High Torpor in the road somewhere) led me to casting High Bolide. And while I heard a knockdown / death grunt somewhere in town, I don't think it was the thief, because he was running around.
In the end, I took out a sword, bought the Fighter vocation with Blink Strike, stood by he inn and thrust him several times (or tried, I missed and he eventually escaped) before picking him up on the fourth try.
Then just stand by the entrance to Cassardis. He will eventually run right into you while he try's to leave the village.
I guess the devs never "fixed" that. :P
