I have to say I'm looking forward to the party banter more than I am anything else. That's what hooked me on Xilia more than anything. The combat was good, but listening to the banter was the most fun part. I hope it's just as good in Zestiria.

Maxwell has certainly been in a number of 'Tales of' games, but not every one. I also don't know of any Tales game that you have Maxwell as a playable character (If you are talking about Milla from Xilia then SPOILER Milla is not Maxwell, and in fact you meet the real Maxwell in the game and he explains it. I hope I didn't spoil that for you if you havent played it yet or are not that far in it yet.)
In addition, the 'Normal' role for Maxwell would be more accurately described as governing the elements rather than the spirits. I think this is an intentional plot twist. The dupe he created (MIlla) to serve his role in his pocket reality ends up replacing him and defeating him. Is he the real Maxwell? At the very least, not once he's dead and Milla is in charge. Probably not even for some time before that.
It was explained in the game. Just because you want Milla to be more than she is does not mean that the rest of us want to pretend to. She was worshipped as Maxwell, correct. That was the point of creating her in the first place. Again, it's explained in game. He did in fact create her, and no matter what Maxwell is not a title to be won by defeating the previous one, it is a specific being. Whether you want to argue who is/should be in charge is your opinion and I will not go into that. Fact remains that, yes, Maxwell is indeed maxwell and no, Milla is not maxwell.
