The facts of those other cases matter with regards to Fair Use. There's a lot of ways to use this content that doesn't conflict with Capcom's interests.
This will be considered, but isn't the most important factor. For instance, if someone is making their own Batman comics and giving them away, the fact that no money changed hands doesn't help much for a Fair Use argument.
Fair Use also covers use of content in a for-profit matter: for instance a professional movie reviewer showing a small clip of the film as an example of what you're likely to see if you buy the ticket.
Fair Use covers all usable intellectual property, and that includes models, textures, and other game assets. I could post a cropped or downscaled texture taken from Monster Hunter, and as long as I was doing it as an example, or to make a point about something, it could be considered Fair Use. If I posted a full size HD texture without any sort of commentary, then chances are I'm merely distributing it without permission.
I'm sure you will agree that using an artists models etc in your mod from another game (commercial at that) does not fall within fair use.
I don't think something like Monster Ark is anywhere close to Fair Use.
And no, taking assets from one game to use in another wouldn't be fair use in any courtroom
We'll take a scenario that happened recently, the GTA modding ban. There were 2 things happening to do something about it, a change.org petition, which many signed, and the noise the community made over it. Needless to say, T2 and R* gave mods back, but not because of the petition, it was because of all the negative reviews and refunds that people caused.
Now, I'm not saying you should boycott Capcom for this, I'm just saying that change.org generally doesn't do anything in these scenarios. If you really want the mod back, here's something you could try (it might not work, but it's better than doing nothing). Message Capcom and ask them directly to reconsider their copyright claim. If enough people give them good reasons to give the mod back, then they might listen to us and bring it back, but remember, they have the last say in whether is comes back or goes forever. It's their content, it's their decision on who uses it.
On another note, it was a shame that they did this, it was the one thing that was making me think of getting ARK
The mod petition was closed several months back, and mod's been all but forgotten right now. Just let it die in peace i guess.
