I have found out why it plays shogun 2 music instead of the fots. The thing is, depending on how many types of a certain unit you have, the music will play in according to that amount. For instance, if the majority of you army consists of traditional units, then it will play the shogun 2 battle music. If the majority is modern then it will play fots battle music. In other words, depending on how "modernized" your faction is (techonology, research, buildings, and military units), the soundtrack played will adjust accordingly to those factors.
If you are talking about simply the little loading battle music then yes that could be, but you should be hearing full fledged FOTS music both during battle and on the strategic level regardless.
Edit: yea I just checked, even from the moment you pick fall of the samurai in the main menu, while you are picking a clan the music changes. I picked Jozai, on turn 1 i fought a battle and it was without a doubt playing fots only music during the battle. If it doesn't for you something went wrong.
