How to pay my bounty when the guard still attacking?

I cant halt using unsheathe weapon like in skyrim when guards still attacking me.

You can wait for it to go away, or just die to the guard and they will take the required amount from you, so long as you have the gold in your inventory. otherwise you have to get the bounty writs from the Thieves Guild dailies that reduce it by 500g each.

Run into water and the guards will drop aggro and leave.

You can pay it at a fence in an outlaw's refuge if your infamy is high enough for guards to kill you on sight. Guards won't bother talking to you in that case, whatever you do.

Oh yeah water, the worst enemy to NPCs in this game.
