Bethesda's pretty chill (for now anyway) with fan-made projects and games being remade in different engines. Just look at Skyblivion. Nintendo on the other hand... That's a different beast. They'll sue your kid for damages if he jumps in a water puddle outside wearing a Mario costume.

CDPR has generously allowed its Witcher3 assets to be used for modding for other games. but NOT vice versa. Using other games' content in Witcher3 is IP infringement, and it's likely CDPR itself will remove such stolen-content mods, rather than face legal issues.

Even similarity can be considered IP infringement.
e.g., if you make an NPC for a game, and if that NPC looks like Hollywood movie star Scarlett Johansson, the real-life Scarlett Johansson can legally sue you. (Not that's likely, but yeah, the possibility is there, because you didn't seek her legal permission first to use her facial feature as a game asset, even if it is for a personal mod that you shared freely without cost.
I know, I know, there are already lots of Skyrim (and for other Bethesda games) mods that feature NPCs or followers that look like specific Hollywood celebrities. But they are in illegal territory.
For such celebrities and other public figures, their face, body and voice are their IP. Remember, Jennifer Lopez had insured her bottom! Guess why. Recently, Scarlett Johansson has sued OpenAI for using her voice illegally (and they wantonly did it, even though she had declined their request to use her voice) for ChatGPT as "Sky AI" voice model (which sounds eeriely similar to Scarlett Johansson's voice, and hence she filed a court case against the mischievous company).
