You BOTH need GS for that mode to be allowed. It has a GS requirement, unlike the 2 Civs that come with the DLC, which do not have that same requirement.
If you do both own it, it sounds like either your install is messed up a little, or you don't have the DLC activated in the mods list.

And i own gathering storm and rise and fall.
And I do have the dlc enabled in the mod list since I do have the option to pick the ruleset.
But il reinstall the game just to be sure. Since i also have some problems with the game taking forever to start. Anyways thanks for the help.
Do you have the "Maya and Gran Colombia Pack" DLC?
Or the New Frontier Pass? (as that does include that DLC)
Overall, you need to own both that DLC and that portion of the DLC requires that you own GS to work. Meaning you can buy the DLC and get the two civs, but if you don't also own GS, then the apocalypse mode won't be active.
If you have Platinum, then you do have GS. From there make sure that GS is enabled in both Steam and in the Civ VI options, and that you are using the GS ruleset in your create game options.

The denoted * leads to this a bit lower on the page:
"*New game mode requires the Gathering Storm expansion to play."
I was under the impression it was included in gathering storm (as would seem logical)
