I don't know why it isn't always there, though. You can also tell them to stop spreading their religion through your lands, and to stop plundering your archaeological sites.
If they agree to do so, and then don't, then they will get a diplomacy penalty, just as you would if you promise to do something and don't follow through.

And then when they get their city down one turn earlier than you, yes they complain you settled too close to them. I just said eff it and used my huge gold reserves to unwisely purchase all the tiles I could to squeeze them out.
