Richter was caught by the police after killing Jacket's girlfriend (that's why he's in a cell in Assault), then he's sent in prison by the police. 50B try to kill him because he's useless in prison and he might tell the police about 'em
You don't have to kill him in HM1, you can spare him. That's what happens cannonically.
The possibility to kill Richter was a sort of test by the devs to see if the players are "normalized" to violence and will try to kill him like all the other enemies
