I've cheated a few times, and got banned twice. The third is permanent I believe. I'd not have cheated online if they made it so you can play your online character offline and mod.
Ain't cheating again - though I can't help but imagine I'll be banned unfairly in future when I play again after they drop a new DLC that entails motorcycles.

Nothing is foolproof, and I'm sure they well know that. But you need to keep in mind that Online is R*'s private property, they can ban you for any reason they want and aren't obligated to talk to you about it or anything. Yes, that sounds kind of ♥♥♥♥♥♥, but you don't walk into people's home's and expect to just put your feet up anywhere and do whatever you want, do you?
Maybe, but nothing is said about that in the currently posted TOU/EULA[www.rockstargames.com], but again, it's their private property, they don't need to explicitly document it in order to lay down a ban for it.

And what are you basing this particular assumption on?
You're wrong. I've spent money given by modders straight away. Invested in T20s and stored them. I only plan to sell them when I need said money.
They won't. They don't want to let the cheaters know what in their awsome hacker toolz gets detected.
Same reason the ban is never for something you did when the ban arrived.
