The thing is, you have to PROVE you did nuttin wrong, in which case, you will have to have your hard drive reviewed by a legally binding company that does those things for law enforcement.
Proving in court would be another matter. As their lawyers will simple state that the loophole in the TOA is binding and enforceable, dued to the way its written, and that you agreed to play at your own risk.
There isn't much else you can do, except as some would claim, buy another copy, and new email account, and crap...start all over.
Proving it is the final key for you to put the burden off of you that you claimed something ELSE was the cause of you getting banned.
Its going to get to the point that somebody will challange the powers to be at Rockstar. A Class Action Suit is going to have to be your only option.
Finding a lawyer that deals with this and gettting the money upfront for him/her to handle your case will be your option.

You broke the law because you recorded this conversation without telling them it was being recorded for legal purposes. Lawyer up..you will need it.
I hate to tell you but the first guy in the video even said himself that it must have been something with his Discord overlay. I'm waiting for the day people get banned for using Steam overlay.
Correct, It's a simple question of if they knowned about this issue in the first place.
His/Her solution for following up will be proving it, then bring all the others in that has the same issue for it to be an Class Action Suit on all parties affected by it.
A Class Action Suit will be the only solution for all parties involved and Rockstar's lawyers will be all over the TOA proving that Rockstar's TOA is legally binding.
He should of at least told them they were going to be recorded for legal purposes, and then do it.
They do have a right not to talk if its mentioned that they are being recorded for legal purposes.
In doing the recording without their knowing it was being recorded, the OP cannot use it in a court of law for fact finding issues on his case.
Haveing their names/postion in the company would also help if they were allow to record the conversation for legal purposes.
It would be interesting to know what their action would be if this ever goes to court.
I use it quite a bit and I haven't gotten banned for it, either.
@OP, just stop trying to justify your ban. You could have gotten banned for glitching, asking for cheated money, etc. The least you can do is own up to it.

hes actually talking to staff who solves tech issues and making smug little comments on things in the text, but seems all polite and understanding more or less in the call
also the guy has a 30day temp ban, it could be anything, its not a perm ban and people are trying to use this video as an example to blame their cheating perm bans on is just absurd

This is why I opened a post saying that cheaters deserve their bans...They will do anything to try and get back that's how their mind works, now they found out something might get them back and 100 % of them are saying how they got banned for no reason because of this and that :D
