That's not really true. Since each country has different views on what gambling is you can easily say by xxx law this is gambling, by US law it would not be. Admitting that its gambling by Peru law, doesn't make it gambling by US law.
If challenged in court the only point of contention is how your content meets the standards of gambling based on THAT countries law. Otherwise the fact that its not considered gambling in most countries would come into play after all.

Well, in peru, there is a lot of gambling casinos with different kind of games insides, so they are very allowed here at peru.
Yeah, in the US it would not considered gambling anymore then the free poker and casino apps you can download on your phone are. It's not regulated because of the inability to cash out.
In Peru it might very well be considered gambling based on their interpretation. The two have no correlation though. If it went to trial in the US they aren't going to use the Peru example as the laws regarding it are totally different and don't apply.
