Courts have specifically said games or software you have to buy BEFORE you even see the EULA are not valid. So either they will start having people sign EULA at the store or on the site, before you purchase or they go bye bye.

also just checked to make sure, the eula is fully visable on the store page. so the odds of this eula being enforced has gone up
