i mean poe1 has all the time p2w you could buy orbs all around the websites even items people was selling for X$ but all the games have that problem at least devs are not selling it,
i just cant remember it was a ban reason or not never seen people banned cuz of that websites was working 7/24 and non of them was closed so

Inofficial RMT will be a part of the game no matter what. There isn't much they can do about it in a F2P game.

When people talk about p2w they refer to stuff that you can buy directly from the devs

This isn't a PvP game, therefore neither the community nor developers care about people paying real money for items. GGG won't support you if you want to pay real money for items in-game, that's why you can't buy them, but you can trade real money for items outside the game, maybe using a third website or whatever, but if GGG finds out you were doing that, it's highly possible your account to be ban.

It's a PvE game, so nobody cares if you spend a lot of money to get the items you want. Your experience won't affect other people's, so everything is fine.

I never said it isn't pay-to-win, I said that nobody cares. Every single game with seasonal content has FOMO, if you don't like it, don't play it, there's nothing you can do against it.

You can't actually argue that breaking the TOS can be considered P2W. The next thign you say is that it's P2W because you can pay other players to play the game for you, since all you have to do is pay some money and suddenly your character will move around without you having to do anythign and kill all the end game bosses for you.

I guess you also consider cheats as Pay2Win? Since there totally are websites that are offering high quality cheats for popular competitive PvP games so that you have a clear advantage over other players.

P2W is when the game offers such an option. Not when the game forbids doing so.
