Starting to get hit by youtube copyright claims via Audiam

Hey there!

This morning I received first copyright claims on my youtube channel, issued by Audiam (Label).
As they spotted exact tracks of Darkest Dungeon it is unlikely this is an false positive.
What this means, is that monetization of Darkest Dungeon Videos is basically not possible anymore as they will be monetized by the copyright owner if not disputed (Audiam).

My guess is that Red Hook Games started selling the Soundtrack separately, which caused the label to now check youtube for instances of these songs.

However with this, the statement from Red Hook Games regarding Monetization is no longer true:

Red Hook Studios Inc. allows for the contents of Darkest Dungeon to be published through video broadcasting services for any commercial or non-commercial purposes. Monetization of videos created containing assets from Darkest Dungeon is legally & explicitly allowed by Red Hook Studios Inc..

So any clarification by Red Hook Sutios would be appreciated.

Yes, this is a pretty common way to earn money by intimidation. In Germany some shady lawyers make money by sending letters, claiming that you hurt copyright (or similar laws) and do now have to pay money. This is indeed a tool installled by law to help the courts but is misused in thoses cases.

In case of doubt just ask Red Hook about it, they should know if you are allowed to use their music. ;)

Mine too.... report this directly to John, the community manager at Red Hook... They can manage to make Audiam withdraw their claim.

This is the process we need to do right now until we get something worked out. Stuart Chatwood (the composer) is working with the companies to get this settled, but for now if you submit the URLs and Track names he can get them whitelisted.

Is Audiam totally stupid? They should see that the youtube video is part of the agreement from Red Hook Studios. Can´t Stuart Chatwood just work together with a serious company - or a company honoring the agreement from Red Hook Studios? Can not be so hard to do so.

I´m really no fan of piracy at all but these companys seem to track the wrong guys instead of fighting crime too often. For me they are not much better than the people they claim to punish. I do not wan´t to know how many people have to pay to them without real reason. Is it just an easy way to earn money without doing much against piracy to them?

It's not like the "The Orchard Music" which just hits you for random ♥♥♥♥ like "There was a noise of wind for 2 seconds, we got a song with that noise as well" and who actually uphold appeals even if there isn't even a song...

YouTube uses bots to flag content as copyright violations. The algorhythm YouTube uses is notoriously brain-dead, since it once assumed that a bird-watcher was violating copyright for recording birdsongs in a forest near his home, and the algorhythm also accused a musician and composer for violating copyright for...uploading his own songs to YouTube as a means of promotion.

Necroing this one a bit.
I'm planning on a Review for the game and I'm trying to get updated on the permissions and legal stuff (possible copyright strikes). Where should we go to complete the form or ask for permission? (the above link was removed).

It's been resolved. We and Stuart Chatwood(The composer) have written permission on our presskit that gives anyone the right to use our game in their videos.

A few hours this issue popped up again.
One of my videos received two claims. Songs found:

Combat in the Vaults
Stuart Chatwood

A Brief Respite (Camp Theme)
Stuart Chatwood

So it's definitely not misidentified songs.

Copyright owners who claimed it are: "Interstreet Recordings"

Affected video:

Wouldn't surprise me if more videos popped up during the next days.

Wouldn't surprise me if more videos popped up during the next days.

I don't know if the owners actually hired these guys, but they're pretty notorious for making fraudulent copyright claims even when people are using their own music.
