Tomb Raider 3 Start menu music being used by another artist and copyrighted?
As the title states. I have been streaming the remastered Tomb Raider games and only where I am on the TR3 start menu, Twitch has muted audio for copyright reasons.
The song in question goes to a chinese artist on Bandlabs, 管浠皓 Charlie Gomez?, Song name Lost and reunited. When I play the file is is the exact music from the game but it has some cheap and tacky music box tune over the top. The game credits only mentions a Nathan McCree for music and sound effects for all of the games. Does anyone know if I should appeal this or if this is somehow legit lol

Sounds like copyright infringment to me, adding an tune track over someone's else composition does not make it theirs to own.
Appeal, since the claimer is not the registered owner or composer.

I would not contact the fraudster, but it should be pointed out that this situation could potentially bring litigation from the actual corporate copyright holders......
There is no option to appeal in a way to say that. Only option that makes sense for twitch is to say "This does not contain the audio" But that will not hold up with the copyright. I have emailed the developers also, just in case. I haven't contacted the potential fraudster as I'd rather hear the devs say its genuine, Or i'll just avoid the menu screen in the future. But it feels like infringement. There might not actually be a copyright on the song but twitch has only flagged that one piece of music as protected content.
Have you checked any details of the "modified song"?
Maybe it's somewhere mentioned on the page that it's originally from Tomb Raider 3?

If he just took the original audio, changed it, and claimed it was his composition, then it's certainly 100% stolen.

I was going to ask if it was this one? (at the beginning it is possible to hear clearly the beginning of TR3 start menu theme and then it goes back to "mixing" the music with it)

It is exactly the same music (and the other 2 seem "too inspired too", the second one not so much but the first one uses the whole music too, cut in parts but use).

Well, at least on youtube he is not monetized, if he sells his musics or not (and if he sells the musics using TR ost) I dont know.
I remember a dude got a weird, but legit, one that he didn't remember ever happening until he went back to the recording. It was THE Mark Morrison making a complaint, and the streamer didn't remember that midstream he subconsciously did an acapella version, by himself, of Return of the Mack just for a few seconds. That wasn't even a recording.

I'd go back to check my original copy of TR 3 later, but I don't recall anything special. I'd think the guy is making a false copyright claim, which he's also using stolen copyrighted music, since I am sure it's original since the 90s.

You asked the devs for clarification in relation to someone using the music of one of their IPs as his own music (just because of some change or add-on to it)?
Sorry but it makes no sense, the musician should be inquired not the devs.

Contacting the publisher is a stronger way to get the troublemaker's attention. After all, they are the ones actually making a mistake, and directly disputing with that person may not lead anywhere when you don't exactly have the power to speak for the claim since it's not your work either.

So it is not asking the devs anything but giving the devs a notification.
I would not expect any response from the devs in regards to that and if devs do anything about you would see the musics that use the TR3 song just be removed (or the entire playlist of the musician vanish if Aspyr or Crystal Dynamics pull a Nintendo move)
Yea, I sent an email as a curtesy to let them know. I've done my part, I cant do anything else. Its up to them to act on it or not.

That is ... considering that nusician is earning any money out of it.
If the musician is not earning anything he can keep all his musics up as it is similar to doing a mix-remix of a music even if just a little is being changed and something that person did just forr fun, not for money.
