InXile calls 'copyright infrigiment' on some indie crap game 'The Alien Wasteland')

Dan (dev of trash fps The Alien Wasteland) received a cease and desist letter from their lawyer asking to either stop using "wasteland" or to prepare facing legal actions against him. Because no one can use 'wasteland'. He is publishing something obviously unrelated to Wasteland franchise - dumb fps game with aliens that no one in sane mind could possibly confuse with Wasteland 2 (apart from InXile themselves for some reason).

I just thought I'd throw it here because it's LUDICROUSLY IDIOTIC on InXile part. It reminds me that 'EDGE' copyright (https://en.wikipedia.org/wiki/Edge_Games) back in the day. I kinda lol'ed, but it's pretty cringy situation. I wonder if they sent copyright infridgement letters to Bethesda for 'Wasteland' in the name of recent Fallout 4 DLC.

"We reached out to the developer of The Alien Wasteland (now Action Alien) directly looking to find an amicable resolution without involving lawyers. The C&D only happened because the developer was unwilling to recognize the issue, only offering to change the game's name if we paid him for it. Asking to be paid for infringing on someone’s rights is certainly a new one for us, so of course we refused.

We do not know if the developer of Action Alien was aware of our Registered trademark when he initially named his game and bear absolutely no ill will towards the creator of Action Alien or the game. We always look for amicable win-win solutions in these cases, where we seek to protect our mark as any prudent business would do, while also helping the other party promote their game and provide a bigger reach than he otherwise would get, so that both parties benefit. In fact, that offer still stands now."

Brian further spoke to our attempts to reach out to him to Shacknews as well:
InXile boss Brian Fargo was upset a deal could not be worked out. "I too am frustrated that we couldn’t work out some fair and simple gentleman’s agreement like we have with others in the past," he told Shacknews. "His only option was for us to pay him money and that simply made no sense. I’m certain that if he had sat down and had a reasonable conversation we would have worked out an arrangement that was to his benefit. Even now we’d still be happy to help him promote his game as we would have from the start."

He also complained about Bethesda calling their DLC Wasteland Workshop. But he didn't take that any further because he would end his company if he tried to sue Bethesda.

Just another developer bullying smaller devs who don't have any recourse.

You know what the problem is here? Apart from the C&D your "boss" gave you guys took the greedy route in trademarking a word. A ♥♥♥♥♥♥♥♥ word. I will give you one thing. Your game is called Wasteland, you didn't want someone to make a "Wasteland 3" or whatever. Or in other words, use your brand name to profit out of it. But the way you applied it with the C&D is utter ♥♥♥♥♥♥♥♥.

Let me tell you why. Because the word "Wasteland" is a trademark it means that other companies (small and indie) cannot use that word if it describes their game or their vision.

This is the same issue that plagued the "Saga" trademark, why do we need to limit the vocabulary of game developers that want to make a game? As long as they don't try to profit by blalantly using your game's name or likeness I don't understand the trademark gimmick.

Its a shame. Wasteland is a good game, but I do not see myself ever buying from you guys again.

if inexile had a case why not go after bethesda the wastland workshop dlc is for an rpg so it closer genre wise its also post apocalyptic seams like a a much stronger case. or as pointed out is it easier to push around people without a legal team? tradmarking a word is ♥♥♥♥♥♥♥♥ plain and simple the fact the game the dev made wasnt good is irelavent to the fact that inexile has only enforced there ♥♥♥♥♥♥♥♥ copyright claim against people who dont have the resources to argue with them.

Do you know who else trademark trolls? Bethesda. They tried to sue Mojang for calling their game Scrolls, because they believed it infringed on The Elder Scrolls.

Then there's King, who believed that The Banner Saga was infringing on Kandy Krush Saga.

Its hilarious that inXile dont see how harmful their pathetic legal actions considering the titles are for themselves. I will never touch any of inXile's games as long as they dont stop being such smugs, and begin to develop a human level of tolerance, common sense and solidarity to other devs. What they do is just disgusting and i hope they realize that soon.
