You can't trademark a common word. So they go after small companies to prove they are 'defending' their 'trademark' while ignoring the bigger fish who would eat them alive. Dick move on inxile's part but if they went after a company with lawyers of their own (ie Bethesda) inxile would lose their trademark because it's a BS trademark and I'm sure they know it.

Common sense should dictate that you cant copywrite a word in the dictionary. But when has law used any common sense, in fact Im pretty sure theres some law against using common sense. Well Crap, I better find a lawyer.

I know I'm late to this particular party but would like to bring up a point.

Whilst you may not be intending to mislead customers your setting at the very least is similar enough that it's easy to see why they've taken issue. Trademark offences have to be actively defended unlike other IP issues which is why you get truly ridiculous cases like Bethesda trying to force Mojang to change the name of Scrolls because it was supposedly competing with The Elder Scrolls series.

In this case, even without the Trademark inXile would still have had reasonable grounds to seek resolution of the issue as there very much is the potential for confusion.

I am a fan of inXile, and Wasteland 2 specifically. I backed the kickstarter. However, I don't agree with their move here. In fact, i'm going to buy this game specifically because they did this. I know it's not the complete compensation that you asked for from them for the trouble of changing the title, but it's something.

It is amazingly lame of InExile Entertainment. Hopefully Waste Management will sue them for using Waste in their trademark. Or better yet, every person who has "land" and is a "landlord" can sue them for copyright infringement, maybe I should copyright those names that are mere descriptors as well. Yeah, I think I'm going to boycott Wasteland 2, just for the heck of it. What a joke. Well, at least that's what the afterlife is for, provided I don't get hit with a trademark infringement suit for announcing it.

or "Alien Copyright Trolls"

Hello little children. I see that playing games don't really help in developing functional brain. So i understand that maybe hard for you to comprehend anything, especially thinking for yourself. I really can't blame you that you don't know anything about trademarks.
