Why is it M but has a Pegi 16 rating?
Why does it have a Pegi rating of 16? should'nt it be rated 18? it says 16 in the begining of the launch trailer on the store page, why is that?

Which rating system are you talking about? Must not be the US, since the ESRB is an industry sponsored and paid for by the industry, and is not government associated at all.

That was the MPAA, which is also an "industry" association, but please. They do it because Congress makes them. They know they can't actually enforce it themselves, because that would be struck down by the courts, but they have perfectly unlimited power to either threaten to tax them, harass them, or grant them loopholes if they play along.

Got anything to back that up? In the 1920s the consumers themselves were making requests for government to start censoring the silient films, so to appease the consumers the film industry created the MPAA. It wasn't the government that was the problem, it was the consumers themselves.

This is the Wikipedia Article on FEPA from 2005. Obviously unconstitutional, they didn't pass it, but Congress has more than enough leverage on the industry to see it shoved down our throats nonetheless.

And no. The Hays code was forced in largely under pressure of the Catholic Church, and adopted by the industry to deflect criticism of its blatantly collusive and anti-competitive practices. In return for censoring their films, including promoting the government's practices of racial discrimination against African Americans, the government turned a blind eye to their numerous criminal violations of the Sherman Anti-Trust Act.

Yes it is. Those hearings are where the ESRB got threatened into existence, they have tried repeatedly to make it government mandated only they can't because of the Constitution. And the Hays code is a perfect example of how the government uses its power over corporations to get around this, to control free speech.
