I will take a guess at it... This game has joker cards and other cards that effect your poker hand, so it's kinda like cheating at poker... you're not playing legit or legal poker, you playing poker with cheats. Oh and it's a lot of fun.

If you mean actually illegal, the real answer is "the government giving you a license to scam people." To legally host gambling events, you need a license. What makes it gambling, is actual money being involved. That's why a casino is legal and you setting up a gambling establishment in your basement isn't.

As for Balatro, you can not earn or lose any (real life) money by playing it, so it is not gambling in the first place. Nor is it anything like poker. It has as much to do with poker as Final Fantasy 7 has with walking your dog - it has a dog, you walk around, but no one would call it a dogwalking game.
