Well, you won't get any copyright claims or takedown with it however.
I think you are missunderstanding what Copyright mean. ANY music is copyrighted. Some are just released under more permissive licensing.

not gonna use it cuz i dont wanna get in trouble even tho the game is free and prob only 10 people will play it

I don't think you understand, yes the OST is copyrighted but it's just like Hotline Miami, it's copyrighted but you mostly have permission to use the OST if you give them proper credit
