Yes, but hauling an inert rocket booster to that altitude is a strain. You can completely remove its fuel of course in the VAB, but you're still hauling dead weight that isn't adding thrust.
My point is it's much more difficult than it looks on paper. Especially if you're doing unmodded Career mode early on. As well, it can also be a BROKEN contract because:
I have one where it wants me to test the Flea between 44 and 49000, betwen 180mps and 310mps. However, once you get near 40000, the game says you are going to orbit (even if your apogee is way under 70000...), and therefore it stops recognizes that you are "flying at Kerbin" and it won't check that your altitude requirement is met, even if it is.
If it's a test contract, then you must activate it (even if it has no fuel, it will work!) when all of the conditions are met. So, repeat the same. Attach an empty booster engine to your craft, and simply activate it when the conditions are met for the contact. Even if it has no fuel, it'll still count.
Problem is you HAVE to activate engines through staging, that's just how the contracts work for engines. So be ready to fiddle around with your stages mid-flight if you don't know exactly when the conditions will be met for the test.
