Generally the legacy collection includes the base game and every DLC that was released before 2019 and is avaible at Steam.
In this case it's about the Scarface Character Pack that was removed from the Steam shop a while ago. Keys from 3rd party sellers aren't dynamic bundles, they have fixed content and because of this, keys from before the DLC was removed still include the DLC and are the only way to buy the DLC now.
Of course you need a 3rd party seller you can trust to not scam but even then you can't be sure if they have keys from before or after the DLC was removed from Steam. So far it looks like there are still old keys in Humble Bundle's stock but in theory the next key they sell could be without the DLC.
As long as you miss anything the key includes, it should activate without problems. Of course you don't get any kind of refund or similar for allready owned content.
Dw, if the key you get is old you will get the DLC
